There are actually multiple reasons why this is perfectly valid social practice. Primarily, as the passage states, punishment is not for the detriment of those being punished, but as a detriment for those witnessing the punishment. That is something that our current legal system does not seem to understand. You cannot punish every single criminal, as almost every human alive is a criminal. The purpose of the punishment is to try to convince us to not do it, or, failing that, to not get caught.

 | / | argument, the entire theoretical purpose      | \ |
 | / | comes into play.  People who have enough wit  | \ |
 | / | and wisdom to see the positive parts of both  | \ |
 | / | sides of the debate then have the wit and     | \ |
 | / | wisdom to pick the side that actually makes   | \ |
 | / | sense.  Unfortunately, that also, is not a    | \ |
 | / | valid social theme given the little amount of | \ |
 | / | thought that recently was displayed in our    | \ |
 | / | country's bent towards war in Iraq due to     | \ |
